NEW RULES FOR LUMP SUM SETTLEMENT APPLICATIONS IN NEBRASKA

On June 25, 2021, the Nebraska Workers’ Compensation Court adopted amendments to Rules 47, 64, 65, and Addendum 2. These changes will go into effect immediately. Some of the rule changes are minor, like updates to the rule regarding Court appointed Independent Medical Examiners. Others are more significant.

Probably one of the most significant changes will effect Lump Sum Settlement Applications. The Compensation Court adopted changes to Rule 47 and Addendum 2, which effectively replace the 2017 Life Expectancy Table with the 2018 version.

The updated 2018 Life Expectancy Table contains only minor changes from the 2017 version, but when dealing with future and present values, even minor changes can have significant impacts on overall exposure.
