Nebraska Workers’ Compensation Court Publishes New Maximum Benefit Rate

The Nebraska Workers’ Compensation Court has released the new maximum weekly income benefit cap under § 48-121.01. For all work-related injuries and illnesses occurring after January 1, 2019, the maximum compensation rate will be $855.00.  This amount equals 100 percent of the state average weekly wage as determined by the Administrator of the Nebraska Workers’ Compensation Court. The state average weekly wage is set according to a statutory formula. The minimum weekly compensation rate remains unchanged at $49.00 per week.

The previous maximum weekly income benefit levels will continue to apply to work related injuries occurring prior to January 1, 2019.
