BAYLOR EVNEN ATTORNEY PAUL BARTA TESTIFIES BEFORE NEBRASKA LEGISLATURE REGARDING PENDING WORKERS’ COMPENSATION BILLS

Recently, Baylor Evnen attorney Paul Barta testified on LB 526 before the Business and Labor Committee at the Nebraska Unicameral. LB 526 is a bill introduced largely by the Plaintiff’s bar with the intention of increasing the amount of temporary total disability benefits that a Plaintiff may receive. Paul Barta, on behalf of Nebraskans for Workers’ Compensation Equity and Fairness (NWCEF) voiced opposition to this bill given that the bill as currently written could provide for Plaintiffs receiving temporary total disability benefits while earning full wages and/or also while being paid permanent partial disability benefits. Further this bill would authorize Plaintiffs to be able to obtain a medical examination of their choosing whenever the employer utilizes a source “outside of the treating physician” for basis of denial. This could lead to odd circumstances when claims are denied for completely non-medical reasons.
